1. Who We Are

These SMS Terms & Conditions ("Terms") govern the text messaging program operated by Surge Business Productions Inc., organizer of the Victoria International Wine Festival ("VICWF," "we," "us," or "our"), operating at www.vicwf.com.

By subscribing to our SMS program, you agree to these Terms in addition to our general Privacy Policy.

2. Program Description

VICWF sends SMS and/or MMS messages to subscribers who have opted in. Messages may include, but are not limited to:

  • Ticket on-sale announcements and early-access offers
  • Event schedule updates and lineup announcements
  • Festival reminders, date changes, and important alerts
  • Wine seminar, dinner, and tasting event information
  • Promotional offers, giveaways, and partner benefits
  • Post-event surveys and follow-up communications

Message frequency will vary. You may receive up to 6–8 messages per month during active festival periods and fewer during off-season periods.

3. How to Opt In

You may subscribe to VICWF SMS communications in any of the following ways:

  • Submitting your mobile number through our website newsletter form at vicwf.com and checking the SMS consent checkbox
  • Completing a paper or digital sign-up form at a festival event and indicating your consent to receive texts
  • Texting a designated keyword to our short code or long code (when promoted at events or online)

By opting in, you confirm that you are the account holder or have the account holder's permission, and that you are 19 years of age or older (the legal age to consume alcohol in British Columbia).

4. How to Opt Out (Unsubscribe)

You may withdraw your consent and stop receiving messages at any time by replying to any message with one of the following keywords:

After texting STOP, you will receive one final confirmation message acknowledging your opt-out. No further messages will be sent, except as required by law. You may re-subscribe at any time by opting in again through our website or at an event.

6. Message & Data Rates

Standard message and data rates may apply depending on your mobile carrier and service plan. VICWF does not charge for SMS messages; however, your carrier may charge for texts received or sent. Please contact your carrier if you are unsure about applicable charges.

7. Supported Carriers

Our SMS program is available on most major carriers in Canada and the United States, including but not limited to Bell, Rogers, Telus, Freedom, SaskTel, AT&T, T-Mobile, Verizon, and others. Delivery to MVNO and smaller carriers is not guaranteed.

8. Privacy & Data Use

Your mobile phone number and any information you provide when opting in are used solely to deliver the SMS program described in these Terms. We will not sell, rent, or share your mobile number with third parties for their marketing purposes.

Your information is subject to our full Privacy Policy. We retain your number for as long as you remain subscribed, and delete or anonymize it upon opt-out upon request.

9. No Alcohol Marketing to Minors

The Victoria International Wine Festival is an event for adults. Our SMS communications are intended exclusively for individuals of legal drinking age. By subscribing, you confirm you are 19 years of age or older (or 21+ if in a U.S. jurisdiction where that is the legal drinking age). We do not knowingly collect information from or market to persons under the applicable legal drinking age.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued participation in the SMS program after changes are posted constitutes your acceptance of the revised Terms.

11. Disclaimer & Limitation of Liability

VICWF is not responsible for any delays or failures in the receipt of any SMS messages. Delivery is subject to effective transmission from your network operator. VICWF will not be liable for any losses or damages arising from your participation in the SMS program beyond what is required by applicable law.

🇺🇸 U.S. Subscribers — The following additional terms apply to residents of the United States and govern compliance with the Telephone Consumer Protection Act (TCPA), FCC regulations, and applicable CTIA Messaging Principles.

U.S. Consent Requirements (TCPA)

In accordance with the Telephone Consumer Protection Act (47 U.S.C. § 227) and FCC regulations, we will only send automated text messages to your mobile number after obtaining your prior express written consent.

By providing your phone number and agreeing to these Terms, you expressly consent to receive autodialed and/or pre-recorded text messages from VICWF at the number you provided. This consent is not a condition of purchasing tickets or attending the festival.

U.S. Opt-Out Rights

Your right to revoke consent is protected under the TCPA. Upon receipt of a STOP message, we will process your opt-out request and send one final confirmation. You may also submit an opt-out request in writing to info@vicwf.com referencing "SMS Opt-Out."

If you believe your opt-out request has not been honored, you may file a complaint with the Federal Communications Commission (FCC) at fcc.gov/consumers/guides/filing-informal-complaint or the Federal Trade Commission (FTC) at ftc.gov.

U.S. Do-Not-Call & Quiet Hours

We do not send marketing texts before 8:00 AM or after 9:00 PM in the recipient's local time zone, in compliance with TCPA quiet hours provisions. Transactional or emergency messages (e.g., event cancellation) may be sent outside these hours when necessary.

Governing Law (U.S. Subscribers)

For U.S. subscribers, any dispute arising out of or relating to the SMS program will be governed by applicable federal law (including the TCPA) and, to the extent not preempted, the laws of the State of Washington as the nearest U.S. jurisdictional reference, without regard to conflict-of-law principles.

🇨🇦 Canadian Subscribers — The following additional terms apply to residents of Canada and govern compliance with Canada's Anti-Spam Legislation (CASL, S.C. 2010, c. 23) and the CRTC's associated regulations.

Canadian Consent Requirements (CASL)

In compliance with CASL, we will only send commercial electronic messages (CEMs) — including SMS messages — to your mobile number with your express or implied consent, as defined under CASL.

  • Express Consent: You have actively opted in via our website form, an event sign-up sheet, or a keyword opt-in, having been clearly informed of the types of messages you will receive and of your right to withdraw consent at any time.
  • Implied Consent: Where you have an existing business relationship with VICWF (e.g., you purchased tickets within the past 24 months) and have not opted out, we may send you commercial messages for a period permitted under CASL.

Identification in Every Message

Each SMS message we send will clearly identify Surge Business Productions Inc. / Victoria International Wine Festival as the sender, consistent with CASL's identification requirements.

Unsubscribe Mechanism (CASL)

Every commercial SMS message will include a readily accessible opt-out mechanism. Replying STOP (or any variant listed in these Terms) will immediately process your unsubscribe request. We will action all opt-out requests within 10 business days as required by CASL, though in practice opt-outs are processed immediately.

Privacy & PIPEDA / BC PIPA

Personal information collected through our SMS program — including your mobile number and subscription preferences — is handled in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and, for British Columbia residents, the Personal Information Protection Act (PIPA, SBC 2003, c. 63).

You have the right to access, correct, or request deletion of your personal information held by us. To exercise these rights, contact us at info@vicwf.com with the subject line "Privacy Request."

Governing Law (Canadian Subscribers)

For Canadian subscribers, these Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts of British Columbia for any dispute arising out of these Terms.
